Viewfinder® National Campus Climate Survey Data Center – User Agreement

This User Agreement (“Agreement”) governs access to and use of the Viewfinder® National Campus Climate Survey Data Center (“Data Center”), provided by Campus Climate Surveys, LLC (“Provider”). By accessing or using the Data Center, you (“User”) agree to the following terms:

1. Intellectual Property Rights

1.1. All content, data, analytics, and materials displayed in or generated by the Data Center are the exclusive intellectual property of Campus Climate Surveys, LLC.
 1.2.No ownership rights to any data contained within the data center are transferred to the User.

2. Permitted Use

2.1. Users may access and view the Data Center solely for the purpose of:

  • Comparing their institution with peer institutions.

  • Viewing data for research purposes.

  • Creating reports and presentations, however, written credit for any notations within reports or presentations must be noted as going to Campus Climate Surveys, LLC

3. Restrictions

Users may not, without prior written approval from Campus Climate Surveys, LLC:

  • Copy, download, scrape, or otherwise reproduce any Data Center data in whole or in part.

  • Distribute, publish, or share Data Center data.

  • Monetize, sell, or otherwise commercially use the data.

  • Create derivative works, benchmarks, or comparative publications based on the data.

  • Circumvent security or access controls to extract data.

4. Confidentiality

The data within the Data Center is confidential and proprietary. Users agree to maintain strict confidentiality and to prevent unauthorized access or disclosure.

5. Compliance & Enforcement

5.1. Any unauthorized use constitutes a material breach of this Agreement and may result in immediate termination of access and may be subject to legal liability.
5.2. Campus Climate Surveys, LLC reserves the right to pursue legal remedies, including injunctive relief and damages, for any violations of the terms of this agreement.

6. Accessibility & Availability

The Data Center are designed to be WCAG 2.0 and Section 508 compliant. Availability is subject to routine maintenance and updates.

7. Amendments

Campus Climate Surveys, LLC reserves the right to update or modify this Agreement at any time. Continued use of the Data Center after notice of changes constitutes acceptance of the revised terms.

8. Governing Law

This Agreement shall be governed by and construed under the laws of the State of Maryland.

Acknowledgment

By accessing the Data Center, you acknowledge that you have read, understood, and agreed to abide by the terms of this User Agreement.
